1. Area of application

Our General Terms and Conditions apply for shipments within the European Union.

We charge a postage and packaging fee amounting to € 5.00 per order up to a weight of 20kg/order/package.

3. Contract conclusion

The sales contract is concluded when we accept your order by means of delivering the merchandise or by means of a written order confirmation.

4. Payment

You determine how you prefer to pay with each order:

    * Prepayment
      Please remit the invoice amount to our account. The account information is sent to you via email during the order processing. The merchandise is shipped to you with an invoice after payment receipt as soon as possible.

    * Credit card
      When the invoice is issued your credit card account is charged with the invoice amount.

5. Cancellation policy

Right of cancellation:
You can cancel the contract within one month without stating reasons in the written form (e.g. letter, fax, email) or - if the merchandise is relinquished to you before the deadline - by returning the merchandise. The time limit begins after the receipt of this policy however, not before the receipt of the merchandise by the addressee (in the case of recurring deliveries not before the receipt of the first partial delivery) and also not before the fulfilment of our duty to supply information according to §312c sec. 2 German Civil Code in connection with §1 sec. 1.2 and 4 German Civil Code Ordinance on the Duty to Provide Information as well as our duties according to §312e sec. 1 sentence 1 German Civil Code in connection with §3 German Civil Code Ordinance on the Duty to Provide Information, before the sales contract has become binding for you by your acceptance of the purchased item.
The punctual dispatch of the cancellation or the merchandise suffices for ensuring the cancellation deadline.


The cancellation is to be sent to:

 
Cancellation consequences: in the case of an effective cancellation the mutually rendered services are to be released and if applicable profits which were made (e.g. interest) released.   Should you not be able to release the rendered service either completely or partially or only in a declined condition, you will have to render value replacement in this respect if applicable. This does not apply in the case of surrendered merchandise if the decline of the merchandise can be solely attributed to its examination - as it would have been possible in a store. Furthermore, you can avoid the obligation of value replacement for the declined condition resulting from the intended use of the merchandise by not using the merchandise as an owner would and by refraining from anything which affects its value.  Merchandise which can be sent by parcel post is to be returned at our risk. You are to bear the costs for the return shipment if the delivered merchandise corresponds to the ordered merchandise and if the price of the merchandise to be returned does not exceed the amount of EUR 40 or if, in the case of a higher price of the merchandise, you have not yet rendered the return service or effected a contractually stipulated partial payment at the time of cancellation. Otherwise return shipment is free of charge. Merchandise not suitable for parcel shipment will be picked up at your location. Obligations for the reimbursement of payments must be fulfilled within 30 days. For you, the time limit begins with the dispatch of the cancellation or the merchandise, for us with its receipt. If you exercise your right of cancellation, a possible partial payment agreement becomes invalid.

6. Cancellation costs

When you exercise your right of cancellation, as far as you are obligated to bear the costs for the return shipment (see cancellation policy), we charge costs for each return shipment of merchandise amounting to the shipment costs incurred for the delivery (see shipping costs).

7. Warranty/Guarantee terms

The statutory warranty and guarantee terms apply.
 
Exempt from the warranty/guarantee are damages which result from natural wear, improper use and insufficient or incorrect maintenance.

8. Retention of title

Until full payment has been effected the merchandise remains the property of the Thomas Heavy Metal Bikes GmbH.

9. Sales tax

All prices include the respective statutory sales tax.

10. Storing of the contractual text

We do not save the contractual text and it cannot be accessed after the order process has been concluded. However, you can print the order data immediately after order placement.
